1. Acceptance of these terms

By creating an account or using Give and Take, you agree to these Terms of Service. If you don't agree, don't use the service.

2. What Give and Take is

Give and Take is a community platform for giving away items you no longer need and finding items nearby that others are giving away. It is free to use — there is no payment processing anywhere in the service, because nothing is ever sold through it. We connect people; we are not a party to any exchange between users, and we don't own, inspect, store, ship, or guarantee any item listed on the platform.

3. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction if that's older, to create an account. By registering, you're confirming that this is true. We don't currently verify age at signup — this is a stated requirement of using the service, not something the platform technically enforces today, and you're relying on your own honesty in agreeing to it.

4. Your account

You're responsible for the accuracy of the information you provide and for keeping your password secure. One account per person. Let us know if you believe your account has been compromised.

5. Listings and exchanges

When you post a listing, you're confirming that you actually own the item, that you have the right to give it away, and that your description is accurate. When you arrange a pickup with another user, that arrangement — including where you meet, when, and how the handoff happens — is between the two of you. We don't verify item condition, safety, authenticity, or legality, and we're not responsible for what happens during a meetup. Use ordinary judgment: meet in safe, public, or otherwise comfortable locations, and trust your own read of a situation over anything a rating or badge on this platform implies.

6. Prohibited items and conduct

You may not use Give and Take to list or request:

  • Anything illegal to give away, sell, or possess where you live
  • Weapons, ammunition, or explosives
  • Drugs, alcohol, or tobacco
  • Hazardous, flammable, or toxic materials
  • Counterfeit goods
  • Live animals
  • Anything sexually explicit

You also may not:

  • Harass, threaten, or discriminate against another user
  • Impersonate another person or misrepresent your identity
  • Post spam, scams, or fake listings
  • Attempt to circumvent a suspension, ban, or moderation decision
  • Manipulate ratings, reviews, or the trust/verification system

This list is a disclosed, reasonable default, not one sourced from a formal legal or product review — update it if your actual product scope differs.

7. Content you provide

You keep ownership of the photos, descriptions, and other content you post. By posting it, you give Give and Take a license to host, store, display, and process it (including resizing/re-encoding images) as needed to operate the service. You're responsible for making sure you actually have the right to post what you post.

8. Ratings, reviews, and trust badges

Ratings and replies should reflect your honest experience. Don't post a rating in retaliation for a report, or manipulate your own rating through fake exchanges. Trust badges (like Trusted Member or Verified Organisation) reflect internal criteria computed by the platform at a point in time — they're a signal, not a guarantee about any specific user.

9. Reports, moderation, and enforcement

We rely on reports from the community, plus our own review, to enforce these terms. We may remove listings, resolve or dismiss reports, and suspend or ban accounts at our discretion, including without prior notice for serious violations. If your account is suspended or banned, you can see why and submit an appeal from within the app.

10. Disclaimers

Give and Take is provided “as is,” without warranties of any kind. We don't guarantee the service will be uninterrupted, error-free, or secure, and we don't warrant the quality, safety, legality, or accuracy of any listing, user, or exchange. You use the service, and arrange and attend pickups, at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, Give and Take and its operators aren't liable for any indirect, incidental, or consequential damages arising from your use of the service, including anything arising from an exchange or meetup with another user. Nothing in these terms limits liability that can't legally be limited in your jurisdiction.

12. Termination

You can stop using the service at any time. We can suspend or terminate your account for violating these terms, as described in Section 9.

13. Changes to these terms

We may update these terms as the service changes. Continuing to use Give and Take after an update means you accept the revised terms.

14. Governing law
